Hey guys, we dropped of February rent 2014 w/ Western Union Money Orders after we got back from the superbowl party Sunday night 2/2/14. We cleaned our apt 2 weeks later and the receipt stubs were trashed. Feb 18 we get an eviction notice and a court date. We get the money order numbers from the store and call the #. Status is cashed on Feb 05... Manager "says he canceled the court date as the money order was "stolen" from the drop box. Provided us with a copy of the 'sent' email. We filed a police report and filled out the western union forms and faxed them to the office. We are now trying to pay march rent ONLINE, but the status is we still owe for Feb with 150+ in late fees. Do we need a lawyer? We lived here for 2+ years whithout ever missing rent including using the dreaded drop box. I'm calling the court tomorrow to see if the date was actually canceled. Manager states that this happened at his last apt complex and the theives use a wash on the ink for the money orders.......

The bank says the washington was cashed. So? It doesn't prove WHO cashed it - it could just as easily have been you. Without proof there is just your word you paid against his word that you didn't. If the bank can show who cashed the check then you wouldn't need an attorney. And if it can't you have no way of proving that you did in which case you have to come up with the rent for that month. I'm in my late 60s and have rented since June 1964. It would never have occurred to me to put something as important as my rent payment in a drop box. You cannot argue your responsibility to pay your rent or the late fees. However, if he gives you a break and says you don't have to pay, consider yourself lucky because wonderful landlords are rare. A simple phone call is all it takes and it is a good idea to check with the court to make sure they have taken the date off the calendar.
