I moved to pennsylvania in April 08. When we tried to start the car it wouldn't start - I called the woman who takes the car payments and told her they could come get it because I was getting tired of dealing with a crappy car. She explained that I still owed $7,000 but they could work a deal with me on selling it and use the money to cover up my loan. I waited for 4 days and they never came and got the car. I think you should file a complaint with the state Attorney General. You can do that here for MO. Lawyer could best tell you the chances for success on a lawsuit. I would be worried that the mechanic lien could get you in trouble for Fraud. There is still money owed to the bank on the car, and it could be viewed as a way for you to gain ownership of the car without paying for it.
Let the mechanics lien take place and see what happens. You should have notified the DMV AND THE bbb AND THE da about this dis-honest dealer the second you found there was "something wrong with the title". It is illegal for that dealer to sell you a car with a bad title. The onus is on them to provide a merchantable title to you at the time of the sale.
